Summary/Abstract: The study proposes to briefly examine the European and Romanian legislation on asylum, as well as the position of the Romanian diplomacy towards the refugees crisis. Unfortunatelly, the European Union and the United Nations response towards the massive migration flows were not as efficient as desired, questions regarding the need for an extended definition of a refugee being raised in several discussions.
