Summary/Abstract: Prior to the Lisbon Treaty’s coming into force, there was a mixed pattern of the EU’s and member states’ competences related to agreements on foreign direct investments. Member states acted on their own when entering into agreements on protection from expropriation and minimum standard of treatment. The negotiating by the Commission of market access terms was subject to consent from member states, but with respect to e.g. investments in supply of services, the EU exercised autonomous competences. As for now, the practical effects of treaties’ revision remain unclear.
