Summary/Abstract: The creation of the Nation Council for Combating Discrimination, as an administrative autonomous authority, has been regarded as an important step towards guaranteeing equality and a contribution to the struggle against discriminatory practices. The study aims to analyze the validity of the juridical acts creating the Council for the purpose of a critical exam of the efficiency of this authority’s competences and attributions. This central question to which the study tries to find the answer is generated by the change in ideological perspective in the matter of the internal human rights’ protection against discrimination, due to the multiplication of the organisms with competence in this field, which duplicates the three branches of the state’s power.
