Summary/Abstract: The right to education is a universal right and one of the foundations for the proper formation of society. It is not an absolute right, it is subject to restrictions on the principles set out in Article 31 (3) of the Polish Constitution. During the COVID-19 pandemic, these restrictions were introduced on a large scale. They were justified by efforts to ensure protection of the health and life of pupils, parents and employees of education system units. Solutions characteristic of education and upbringing in healthcare entities were applied, i.e. for conditions in which there is a constant conflict of the right to education with the right to health care. The aim of the article is to determine whether the applied measures, despite the fact that they were mostly identical, had the same nature in the COVID-19 pandemic conditions and whether their application caused the same effects.
