Summary/Abstract: In the wake of the decentralisation process which began after December 1989, the prefect was entrusted with a fundamental constitutional role, in that it is the representative of the Government in the territory and, consequently, the guardian of the legality of the power transfer from the central to the local level. However, as important as the mission of the prefect is, there have been frequent legislative changes to its legal status. Without the risk of exaggeration, we can say that the prefect embodies, perhaps more than any other Romanian administrative institution, the effects of the constant interference of political power in the proper functioning of the public authorities, as well as those of the periodic oscillations that occur in the executive power. +The present study aims to analyse the legislative developments concerning the legal status of the prefect, between its inclusion in the category of senior civil servants and its qualification as a public dignitary. Aware that both solutions imply advantages and disadvantages that are difficult to ignore, we will conclude with our vision on the future of the prefect in the Romanian legal and administrative landscape.
