Summary/Abstract: The election of the mayor, as a public authority which is the closest to the citizens is undoubtedly based on the assessments of the electorate, which are both objective and subjective. From this perspective, it is not surprising that our legislator is inclined to sanction the conduct of the elected mayor, who is suspected to has failed to exercise his/her duties, or who disappoints the inhabitants of the territorial and administrative division to such an extent, that they resort to the organization of a local referendum for the removal from office of the respective mayor. On the opposite pole, it is often noted in practice that there are also situations in which a person obtains several terms of office as mayor as a result of the validation and confirmation over time of the trust of the citizens who have elected him/her. However, this study aims to analyze the particular case of the termination of the mayor’s term of office, construed as a sanction, as regulated by the Administrative Code in force, having as ground the holding of such a local referendum in June 2022.
