Summary/Abstract: The unification of the rules of private law had as an effect the disappearance of the classic distinction between the civil and the trade law. The replacement of the notion of trader with that of professionist created a series of confusion in practice. The ambiguous distinction between trader and proffesionist created in practice a series of confusion concerning the possibility of continuing usage or not of the word trader, a clarification being necessary
