Summary/Abstract: India and Romania are two legal areas between which there are considerable differences, determined by historical, cultural developments and specific traditions, which have left their mark on the evolution of legal norms. From this perspective, the legal regime of the institution of inheritance is one of the most marked by the cultural differences and traditions existing in the two countries, especially when the principle of equality in general and gender equality is at stake. The study aims to explore the constitutional and legal basis of the right to inheritance in the two states from the perspective of the principle of gender equality, revealing both the history of regulations and the influences that global developments in this field have on the regulations and jurisprudence of the two states.
