Controversies Regarding Criminal Liability of Companies

Summary/Abstract: The present article aims to approach the issue of criminal liability of companies, as well as the crimes which can be committed by companies. This institution was originally regarded with some reluctance, but in the meantime, it was accepted, enforced, not only by doctrine, but also by the courts of law. Starting from the controversies pertaining to the criminal liability of a company, we have attempted to present the evolution of this institution in Romanian law and the direction in which it is heading given the present background. Furthermore, this material is destined to create a better understanding of the importance of criminal liability of a legal entity; for this reason, we will clearly analyze, from a legal criminal perspective, the crimes which can’t be committed by a company and the crimes which give room for different opinions; we will conclude by presenting the jurisprudential opinions, based on the data acquired from the Public Ministry and the relevant jurisprudence.
