Summary/Abstract: The postponement of the enforcement of the penalty is a creation of the legislator through which the framework of alternative means to the prison sentence was diversified with the aim of putting at the disposal of the courts solutions that would support those found guilty of committing crimes of low severity. Thus, the postponement of the enforcement of punishment appears as a legal institution that confirmed the policy of renewing the criminal legislation. The main consequence of ordering such a solution is represented by the fact that the person against whom such a solution was ordered is not subject to any disqualification, prohibition, incapacity that could arise from the crime committed. The effects of ordering a postponed sentence solution are of two kinds, and the person found guilty of committing the crime should fulfill a series of subsequent conditions in order not to attract repercussions on him. The complexity of the effects produced by such a solution derives from the need to ensure an effective framework that leads to a quick and definitive social reinsertion.
