Legal Issues and Problems in The Application of Art. 2 Of The Condominium Ownership Management Act

Summary/Abstract: The contract within the meaning of Art. 2 of the Condominium Ownership Management Act (COMA) establishes a special regime of management of common areas of buildings under condominium regime, constructed in closed-type residential complexes. The law regulates the formal requirements for conclusion of a valid contract, but does not specify its minimum content which allows unfair contract terms to be imposed on owners. Legal theorists and practitioners argue that the general condominium management rules set forth under COMA are derogated by the special regime under Art. 2 of the same Act, which is applicable towards management of common parts of buildings in condominium mode. However, it is also accepted that there is no obstacle for the management contract under art. 2 to refer to the general rules of management. A review over the existing legal practice shows that the special regime most often consists of specific rules that are determined by the Investor. This scientific report refers to the legal issue of whether or not the contract under Art. 2 has to consider the logic and spirit of the mandatory provisions established by COMA for the general regime and rules for condominium management. The legal opinion provided for in this article contains a coherent statement and detailed analysis of the reasons why the contract under Art. 2 of COMA should correspond to the logic and spirit of the rules, established under the imperative provisions that are laid down in Art. 51, para. 1 to para. 6 of COMA.
