Right to refrain from dangerous work

Summary/Abstract: No matter where we are, our life and health are subject to special legal protec- tion. However, they do not constitute absolute rights. The aim of this article was to analyse situations in which an employee has the right to refrain from performing work or even to move away from the place of work. The institution in question does not always cover all persons performing work. Health services, whose aim is to provide services for the protection of life and health, cannot make use of this right, except in certain situations, when they are also exempt from this obligation. The regulations in question are intended to protect the working conditions of employees and also to motivate employers to ensure that these conditions are in accordance with the law, including health and safety regulations.
