Medical mistakes – Ukrainian experiences

Summary/Abstract: In today’s normative legal acts of Ukraine, there is no such concept as ‘medical error’ and its meaning is not determined. The lack of regulation of medical errors at the legislative level detriments the interests of patients, doctors, and health care in- stitutions, i.e. the patient is not sure that he will receive compensation for the caused damage; a doctor is not protected from unsubstantiated claims; an institution is not protected from possible arrests of bank accounts and capitals. Significant adjustment, clarification, and improvement of the liability institute for the guilty person taking into account specifics of the legal relationship doctor – patient, is a necessary condition for citizens to realize their rights guaranteed by the Constitution and laws of Ukraine, including the right for life and health.
