THE NEED FOR A BETTER UNDERSTANDING OF LAW OF OTHER COUNTRIE

Summary/Abstract: The interest for foreign laws, 'and more particularly satisfying that interest by applying the comparative law method, rose in our country to quite a degree after the Second World War. This was partly due to post-war developments in Yugoslav society and to a multitude and importance of relations with foreign element, which were continuously established by our citizens and our economic organisations. A thorough knowledge of substance and of the development of law of foreign countries by those legal subjects who are taking part in legal relations of an international character and in legal relations with a foreign element, is quite necessary out of the following reasons: in order to use correctlv the freedom of entering into contract and to provide properly for the application of foreign law; in order to understand and apply in a correct way the clauses of contract which provide for the application of foreign law, or which are formulated on the ground and in the spirit of foreign law; then in order to apply foreign substantive law rules which are referred to by Yugoslav legal norms; and, in general, in order to use correctly, in the sphere of foreign trade transactions, a whole series of different and usual terms, formulations, forms, usages of trade and model-contracts. Obtaining knowledge of the law of foreign states is particularly important when entering into contracts related to foreign trade transactions, namely at the moment of establishing status situations with a_ foreign element. In order to fulfil these tasks in a satisfactory way, the interested individuals and competent officials, as well as the institutions of society in this field, should be constantly engaged in relevant study and work. This is the only way of creating conditions for a greater and better understanding of the law of foreign states, since this is at present our social duty and a necessity.
