Summary/Abstract: The issue of the holder (the criminal investigation body or the prosecutor) of the proposal to authorize the special research method provided for by art. 152 Criminal Procedure Code determined, in judicial practice, alternative opinions. The clarification of this matter leads to the necessary conclusion that the acts of referral to the judge of rights and liberties or the court of law are in the exclusive competence of the Public Ministry.
