CHALLENGES FOR IMPLEMENTATION OF "FORCE MAJEURE" IN COMMERCIAL CONTRACTS

Summary/Abstract: In the past few years we have witnessed events that are not common to Western society and that until recently were considered unthinkable in the 21st century. The purpose of this article is to consider the issues regarding the unrestricted application of force majeure circumstances arising after the conclusion of contracts between traders. This hypothesis poses a number of challenges that would arise in the unrestricted application of "force majeure" clauses in commercial contracts.
