THE SUBJECT OF CRIMINAL OFFENCE

Summary/Abstract: While using in his article the marxist juridical and sociological approach, the author attempts to find an answer to some questions, seeming important to him for actual consideration of the subject of criminal offence within the theoretical system of Yugoslav positive criminal law. The following issues are thoroughly elaborated in present article, namely: physical person as a subject of criminal offence, accountavility for one's acts as an element of the subjectivity of the perpetrator of the criminal offence and the guilt of the subject of criminal offence. The author points out that problem at issue in the analysis, although interesting and significant, has not been given an adequate place in research. : Without resorting to postulate-type of assertions, the author engaged himself in an open research analysis with the aim of finding a suitable position for the subject of criminal offence without which it would be impossible to decide at court on any criminal offence, which includes the impossibility of setting a realistic criminal policy and, finally, without which it would really be impossible to build up a reasonable system of contemporary criminal law.
