Summary/Abstract: The EU is facing a turning point in its development. In addition to raising questions about the future of the European Union after Brexit, it is important to consider the relevant legal aspects of Brexit. As the Community existed before the accession of Great Britain (1973), so the Union, as its legal successor, will exist after the British withdrawal. If in practice, in relation to the implementation of the Treaty of Lisbon, the effectiveness of the functioning of the institutions of the European Union would prevail, it would be a realistic conclusion that it is a democratic union with an optimal institutional architecture. Only in this way would it regain the trust of citizens and affirm the meaning of its formation and existence. In case of the opposite development, the European Union will face a further increase in extremism in its member states.
