NEW WAYS IN THE THEORY AND PHILOSOPHY OF LAW

Summary/Abstract: While analyzing the application of the materialistic-dialectical method in legal sciences, the author, pointing particularly at the theory and philosophy of law, considers the scientific achievements in the works of professor Lukić. Beginning from otherwise neglected significance of the dialectical in this method, the author first of all considers Lukić’s conceptions in the sociology of law and in the sociology of morals. He expresses high opinion in relation to the results of Lukić's analyses, but also offers some qualifications regarding the need for the existing of the so-called particular sociologies. The second part of the article contains, on the ground of consolidating the notions of philosophy and philosophy of law, author’s views on the general science of law. For him, this is a theory of law in the light of a wider branch, which is also general; namely the philosophy and sociology of law may exist only out of the reasons of efficiency, since they are narrower in their characteristics then the theory of law. At the end the author emphasizes that contribution of professor Lukić is great not only in his works, but also in the field of educating scientific workers. He also mentions exceptional human characteristics of the personality of professor Lukić.
