SOME REMARKS ON THE RELATIONSHIP BETWEEN THE STATE AND SOCIETY

Summary/Abstract: Using already known literature and materials the author elaborates in a fresh manner on some aspects of the relationship between the state and society. The classical and medieval conceptions related to this problem are only touched upon in the article as far as their substance is concerned. The author treats mainly the bourgeois and marxist conceptions of the above relationship. While determining the essence of the bourgeois conception of the state and society, the author concludes that this conception means in fact the apology of the bourgeois state. This is particularly illustrated by the standрoints of the bourgeois theory of state related to the bourgeois and the socialist states and to their relationship toward man and society. Namely, the former type of state allegedly defends the rights and freedoms of man, while the latter one suppresses these rights and freedoms.. Treating the socialist state the author, while beginning from the already known marxist standрoint on the historical position and role of state, goes further as he determines that the state in general is a progressive phenomenon as far as there exist reasons provoking its origination. He also concludes that some marxist authors one-sidedly point out only at tlie class side of state, omitting thus the assess historical position of that phenomenon. The author, along these lines, emphasizes the work of professor Lukić concerning social function of state. Lukić, namely, pointed at this one-sidedness although not always in the dialectically correct manner. The author concludes at the end of the article that state as a multi- -form phenomenon may be encompassed in its totality only by using the method of historical materialism. He also criticizes the standрoint of professor Lukić that the legal method is the principal one in the sphere of law and of relevant sciences.
