Summary/Abstract: This study examines how the right to freedom of expression and the right to privacy are enforced on social media platforms. To do so, it seems necessary to first provide a conceptual and taxonomical overview, followed by an analysis of freedom of expression and privacy rights and the legal problems associated with them. It should be noted at the outset that neither of these rights is unproblematic, and the draft EU Digital Services Act, which is currently being prepared, may offer a partial solution to this problem, and that there are also legislative attempts in the Member States to address this issue, but given the complexity of the problem, no comprehensive solution has yet been found.
