Summary/Abstract: In accordance with art. 1615 French Civil Code, the sale of a ship, like the sale of any other property, includes all accessories. The concept of ship accessories can be difficult to define. In principle, the parties will clearly identify the vessel to be sold, which includes its accessories. But this freedom of contract does not apply to administrative documents such as the Certificate of Registration of the vessel (franchising act) or the license to operate a fishing vessel (permit to operate a fishing vessel). The seller is obliged to hand over these documents, considered necessary for the normal use of the vessel, otherwise the Court of Cassation ruled that the delivery of the vessel did not take place properly.
