Summary/Abstract: This study brings forth certain issues pertaining to the concept of negotiated justice, the influence of adversarial law on the Romanian law system, but also the most significant means by which these two institutions are implemented in national law, by also considering the situation of the Romanian justice system at the time these institutions were regulated. On the other hand, we will point out the most important aspects regarding the institution of the admission of guilt agreement in our system of law. We will also attempt to analyze the main aspects which allowed for different interpretations in judicial practice.
