The problem of the fairness of punishment in criminal law

Summary/Abstract: This article aims to prove the thesis that the punishment for a crime within the meaning of the Penal Code is a function of the principle of justice. The theoretical foundations in the study of the thesis include the consideration of the following issues: 1) To what extent the legislator ensures predictability of punishment in accordance with the principle of justice in the Penal Code; 2) Comparative legal aspects between the two categories: punishment and justice; 3) Proposal for creation of evaluation criteria for ratio and proportionality between punishment and justice.
