LEGAL ASPECTS OF THE CREDIT CARD TRANSACTION

Summary/Abstract: Legal relations pertaining to the credit card transactions are not sufficiently regulated in our positive law, and in our business practice either. The lack of sufficient statutory regulation of legal relations regarding the credit card transactions in foreign countries is overcome autonomously, primarily through the form of general (fundamental) rules (conditions) of business and business customs (usances). These autonomous forms of legal regulation of credit card transactions in Yugoslav law represent in fact the automatic acceptance of the rules of business practice, without the appropriate conscious influence and the relative statutory regulation. This may lead to a number of detrimental consequences and that is why it is necessary to bring more initiative of the business people and the business associations in this matter in the creation of new business rules and general regulations to govern this activity. However, these autonomous forms of regulation of legal relations in respect of credit card transactions cannot regulate or solve all legal problems in this field, which is why it is necessary to have relative statutory regulation of certain aspects in the credit card transactions.
