ON LEGAL PHILOSOPHY

Summary/Abstract: Being of opinion that legal philosophy as a discipline can be discussed only on the grounds of examining its actual state, the author describes various standрoints towards this discipline in our country, as well as Prof. T. Živanović’s most recent contributions. Those have a connection with remarkable treatises and the most recent development of legal philosophy in the world, so that the author concludes that the historical development of this discipline has in the actual social conditions contributed to its large and evident enthusiasm and led to remarkable results. After reviewing various standрoints on legal philosophy the author focuses the analysis to the greatest problems arising in defining legal philosophy, its subject and its main characteristics. The author concludes on that basis that the basic research fields are already constituted. Those are: the necessity of posing clear criteria of defining legal philosophy, the necessity of establishing a relation between legal philosophy and legal science, as well as taking measures to advance the legal philosophy because of its prestige and obvious values.
