The Abuse of Law in Criminal Proceedings (A Theoretical Outline)

Summary/Abstract: The article analyzes the issue of abuse of law in criminal proceedings from the perspective of the implementation of the trial functions of adjudication, prosecution and defense. The aim of the analysis presented in the article was to determine the gradation of the degree of abuse of procedural rights and their impact on the hit decisions regarding the criminal responsibility of the accused and the assessment of the reception of the concept of abuse of the right to the Polish criminal process. Using the dogmatic and legal analysis method, risk factors have been identified that strengthen the ability to abuse the law in the criminal process in various situations and process arrangements and at various stages of its course. In the research, an attempt was made to answer the question whether abuse of procedural rights is a premise for considering a certain act unacceptable.
