Summary/Abstract: Disability is a cross-cutting phenomenon that touches virtually all areas of social life. It is as old as human community itself. Starting from the assumption that persons with disabilities enjoy all human rights, the author insists that all stakeholders implementing universal global and regional human rights instruments have to take the necessary measures in order to enable persons with disabilities to enjoy all the rights put forth in the above-mentioned documents. The author insists that Serbian authorities should implement consistently the UN Standard Rules for the Equalization of Opportunities for Persons with Disabilities, relevant regional instruments, take measures to harmonize Serbia's legislation with the provisions of the Convention on Rights of Persons with Disabilities and ratify the Convention. Besides implementing general international and regional legal instruments, the author maintains that authorities of a particular country should prohibit discrimination on the grounds of disability in relevant national legislation. One should consistently implement the Constitutional prohibition of discrimination on grounds of physical and intellectual disability (article 21, clause 3 of Serbia's Constitution). The author furthermore insists that all relevant stakeholders should consistently implement Serbia's Law on Prevention of Discrimination against Persons with Disabilities. The author insists that the relevant authorities should adopt all the above-mentioned measures in co-operation and partnership with persons with disabilities and their organizations. In that way one can create legal framework for a society in which persons with disabilities shall enjoy equal opportunities for full participation in all areas of social life.
