Summary/Abstract: In the period from march 2020, a state of emergency was repeatedly declared and extended due to the so-called the COVID-19 pandemic. The article points to the constitutionally compliant possibilities of optional restriction of basic rights and freedoms as well as the optional possibilities of imposing obligations during crisis situations in the Slovak Republic with an emphasis on the first state of emergency, which represents the least serious crisis situation. The solved problem required an analysis of the intention of the constitutional body, who more than 20 years ago incorporated constitutional norms providing a legal basis for solving crisis situations into the basic law of the state. Subsequently, he adopted a constitutional law that implements the blanket constitutional norms in detail. From the point of view of criminal law, I point out to a crime that the perpetrator can commit exclusively during a crisis situation.
