Polemical about the admissibility of taking into account discounts and rebates when determining cost compensation from motor vehicle liability insurance

Summary/Abstract: The article deals with the problem of taking into account within the framework of motor vehicle third party liability insurance by insurance companies in determining compensation using the cost method the discounts and rebates possible for the injured party in workshops cooperating with the company. According to the authors, the possibility of taking into account discounts and rebates depends on the cir- cumstances of the particular case and, in principle, cannot limit the right of the injured party to choose the workshop whose services he or she would like to use, even if the prices of services at this workshop exceed the prices of services at the insurer’s partner workshop.
