Summary/Abstract: The work presented represents a result of the author’s personal conviction about the necessity of legislative regulation of the institute of euthanasia, in the sense of unreserved respect for basic human rights. In this regard, in the following article we deal with the argumentation that confirms the taken stance, a dilemma about (non)permanent right to die as a correlative to right to live accentuating the relevance to the quality of life in the context of euthanasia, and the conceptual explanation, the rarely mentioned institute of a “patient’s testament” as necessary, the accompanying segment of legalization of euthanasia. The author also provides a short section of the current state of regulation of the “right to a dignified death” in the Civil Code of the Republic of Serbia, which is still in the preliminary draft
