The problem of criminal liability of associations of persons

Summary/Abstract: The fundamental arguments against the capacity of legal persons to incur criminal liability are not convincing. On the contrary, without contradicting the principles and views of the doctrine, the legislator may introduce criminal liability of legal persons if it considers it expedient for criminal and political reasons. In doing so, however, it should carefully analyse the specifics of the corporation's structure and take into account the resulting limits and characteristic features of such responsibility. There are many indications that, in Germany too, the introduction of criminal liability of legal persons is a matter of the near future. The task for the science of criminal law in this situation is to avoid shaping the liability in such a way as has already taken place in the USA and EEC law, which sets the limits of this liability too broadly.
