Summary/Abstract: The instruments of the substantive criminal law can be considered asimportant elements of the strategy related to combating terrorism. In the EU, there are alot of minimum rules to be followed are regulated by the European common legal stepdecided by the European Parliament and the Council. This legal document is the Directive2017/541 on combating terrorism which replaced the former legal cooperation based onframework decisions. Taking account that according to the Article 28 of the Directive theMember States should bring into force the laws, regulations and administrative provisionsnecessary to comply with the Directive by 8 September 2018, our aim is to make acomparative analysis concerning the Hungarian and the Romanian criminal law and toanswer the scientific question: has the transposition of the rules been successful in thesetwo countries.
