Summary/Abstract: In the case Csata v. Romania, the issue of legal recognition of gender identity was analysed, taking into account the provisions of Articles 8 and 14 of the European Convention on Human Rights. The Strasbourg Court examined whether the Romanian state had fulfilled its obligations regarding the principles of non-discrimination and the right to private life. After unsuccessful friendly settlement negotiations, and a unilateral declaration from the state admitting the breach of rights, the Court noted that any such declaration should provide for measures to address a substantive issue under the Convention Thus, the extent to which the contracting party respected the balance between the general interest and the individual interests of the applicant was evaluated.
