Summary/Abstract: The subject of this work is compulsory license for patents relating to the produce of pharmaceutical products through a comparative research of international conventions and treaties, EU legislation, the legislation of Republic of Serbia and Bosnia and Herzegovina, and the practice of states that have issued compulsory licenses for patents relating to the production of pharmaceutical products. The work is divided into two parts. The first part is review of the historical development of compulsory licenses and the practice of issuing compulsory licenses for patents relating to the production of pharmaceutical products. The second part refers to the theoretical consideration of compulsory licenses for patents relating to the production of pharmaceutical products intended for export to countries that have public health problems. The aim of the research is to determine access and interest of developed countries, on the one side, and the developing and underdeveloped countries, on the other side, in the use of compulsory licenses for patents relating to the manufacture of pharmaceutical products.
