Summary/Abstract: In legal theory and science there are no equal opinions about origin and begining of concession. An opinion prevails that they occured in ancient times and that development of this institute, although not in the present form, could follow since inception periods of the Hamuraby Law, ancient Rome and Greece. The term itself also changed, and while now in our current legislation, concession is defined as the right to conduct economic activities using public goods, natural resources and the other assets of public interest, and the right to perform activities of general interest, in accordance with the law this law is passed on to the concessionaire for a specified period of time, under the conditions stipulated by law, by paying concession fees. Intention of the regional and economic connections and integrating in Europe Union takes needs of the investment in big projects. Countries in transition and low developed countries do not have big economic sources, therefore they have a need for engagement of foreign capital for the implementation of their goals and satisfaction of their interests.
