Summary/Abstract: The article analyses the three elements of the duty of loyalty of the employee towards the employer. On the basis of this analysis the author formulates a proposal for its treatment as general obligation of the employee towards the employer, and not as an element of the main obligation for performance of the work. De lege ferenda it could be proposed the provision of Art. 124 of the Labor Code to be supplemented in that sense.
