Summary/Abstract: This article aims to present the evolution of the regime of state aid, through its historical origin and development of their prototype – state subsidies. Next, the article places the state aid regime in its modern context – as one of the fundamental rules guaranteeing the functioning of the internal market of the European Union, based on fair competition. The initial concepts for the definition of the state aid regime and its current form are explored. The article then traces the stages of evolution of state aid, examined through the legislative amendments and the jurisprudence of the Court of Justice of the EU. Finally, the current trends in the development of the state aid regime are examined, focusing on the “soft legislation” measures of the European Commission adopted in recent years, some of which are still relevant to this day.
