Summary/Abstract: Every human being is born free and equal in dignity and rights. Since then, many international documents have been adopted that protect people, but the Universal Declaration of Human Rights(1948) is something that founded all other documents and declarations and opened the way for further progress of society and humanity in general. However, international rules and guarantees are not always a guarantee that the rights of the weak will be preserved. Those standards were adopted in the best of intentions, recognized by the largest number of countries and exclusively intended for the benefit of all mankind. If human rights are inalienable and cannot be taken away for any reason, it means that they belong to all people, including those who are serving a sentence. However, international rules cannot ensure a perfect prison system. Rules, which prescribe international conventions, should be the basic minimum that prisons should not neglect because they provide the minimum conditions for the humane and efficient performance of the role entrusted to prisons. For this reason, in Montenegro, as in other countries of the region, the basic principle of the criminal legal system was established, which promotes respect for the human dignity of the person and a humane attitude towards man. When it comes to juvenile perpetrators of criminal offenses in Montenegro, on December 20, 2011, the Parliament of Montenegro passed the Law on treatment of minors in criminal proceedings, which regulates the treatment of minors as perpetrators of criminal acts, children and minors as participants in the proceedings. , which is based on respect for human rights and basic freedoms while respecting the best interests of minors, taking into account their maturity, level of development, abilities and personal characteristics, as well as the severity of the criminal offense, with the aim of their rehabilitation and social reintegration. With the adoption of this Law, a new period begins in juvenile justice in Montenegro. According to the International Convention on the Rights of the Child, all activities concerning minors must be carried out in their best interest. Therefore, deprivation of liberty must be a measure that is applied only as a last resort and in the shortest possible form and only in special cases.
