A few remarks on the notion of a contr-revolutionary crime

Summary/Abstract: A contr-revolutionary crime was an institution appearing only in the criminal law of the USSR. The Soviet lawmaker used the notion of the contr-revolutionary crime for the first time in 1922. The next codification from 1926 did not introduce any changes to it, which allowed the very notion to function in an unchanged form to the end of the 1950s. Although in the postwar period the Polish lawmaker aimed to maximally bring the law regulations closer to Soviet solutions, it never decided to introduce the institution of the contr-revolutionary crime into the Polish civil law. It was included beyond legislation — by means of the directives of Zgromadzenie Ogólne Sędziów Najwyższego Sądu Wojskowego from December 19th 1952. Although it functioned only in the doctrine of the criminal law, it had a significant influence on adjudication activity of courts becoming one of the examples of Stalinisation if the Polish criminal law.
