Reasons for opening remedial proceedings

Summary/Abstract: This article presents the premises for opening the most characteristic of the restructuring proceedings – sanation proceedings. It contains a broad analysis of the concept of restructuring capacity and the grounds that must be met and those that cannot occurin order that relevant proceedings could be opened. The study makes reference to other restructuring proceedings, as well as to the jurisprudence of the Supreme Court and common courts, and also other legal acts, including the Bankruptcy Law in particular.
