Summary/Abstract: RESEARCH OBJECTIVE: The main research objective of this article is the analysis if in the light of the rules of the Constitution of Poland is there any entity not mentioned in art. 10 which could balance the constitutional position of the legislative and executive power – perform the role of the “fourth estate”. THE RESEARCH PROBLEM AND METHODS: The basic research problem is an attempt to answer the question if according to the Constitution any entity could perform the role of the “fourth estate” and how the Constitution should be amended to introduce the “fourth estate”. The institutional-legal analysis of the rules of the Constitution was used with particular emphasis on the language-legal, systematic, doctrinal and judiciary interpretation. THE PROCESS OF ARGUMENTATION: The article starts with the comments on the constitutional principle of the division of power. Next, considerations on the term “fourth estate” and analysis of the rules of the Constitution are focused on finding an entity that could perform the role of the “fourth estate”. The article ends with propositions of the amendments to the Constitution that would allow the sovereign, territorial self-government and organs of state control and defense of law to balance the constitutional positions of the legislative and executive powers. RESEARCH RESULTS: In the light of the rules of the Constitution of Republic of Poland there is no entity performing the role of the “fourth estate”. CONCLUSIONS, INNOVATIONS AND RECOMMENDATIONS: It seems necessary to introduce amendments to the Constitution of the Republic of Poland that would strengthen the constitutional position of the Nation, territorial self-government, state control and defense of law organs, as well as the public prosecutor’s office, which will allow them to perform the role of the “fourth estate”.
