The Abuse of Rights in Public Procurement Law

Summary/Abstract: The abuse of rights is one of the fundamental legal constructs of private law. Due to the Public Procurement Law regulation referring to the rules of the Civil Code, the institution of abuse of rights is also applicable in the field of public procurement. The aim of this paper is to analyze the usefulness of this private law institution in the area of Public Procurement Law and to examine whether its application is connected with circumstances and rights characteristic of the public procurement system.
