Summary/Abstract: The discussed resolution of the Supreme Court concerns the admissibility for insurers to apply discounts and benefits for parts and services used by the so-called partner workshops cooperating with insurance companies when determining the amount of compensation awarded to victims for damage to vehicles. The ruling supports the admissibility of such a solution while emphasizing the need to avoid any automatism in this regard. The arguments indicated by the Supreme Court have been analysed and assessed in the commentary from the perspective of the injured parties’ right to freely choose a repair workshop, as well as the principle of their cooperation with the insurance company and the obligation to minimize damage.
