What role does ownership of the token play? An economic analysis of the European regulations applicable to cryptoassets

Summary/Abstract: As more and more investors emerge in the crypto-assets market, it makes sense to consider whether there is a need for regulation in this area. The European legislative has taken the first steps in shaping an European regulatory framework for crypto-assets. In this study, we will start an economic analysis of the law applicable to crypto-assets, focusing on an essential element of a well-functioning market: ownership. We will present the main difficulties identified in applying these economic theories to tokens, concluding with some guidelines in this area.
