Some aspects of payment and debt forgiveness in relation to the new concepts of ownership and appropriation of property

Summary/Abstract: In this study, we aim to carry out an analysis of several aspects regarding the legal institution of debt remission and that of transfer in lieu of payment, in its typical form and in that of assignment of claim instead of execution of debt. The subject will be approached by relating these legal operations to the new theories developed in the matter regarding the legal notions of things, property, subjective right, the legal characters of rights in rem, of rights of claim and their role in the process of appropriation of things.
