Legal and Implementation Conditions for Ensuring the Continuity of State Operations – Selected Problems

Summary/Abstract: Each state is an entity whose existence and effective operation is con-ditioned by its broadly-understood functioning, which, from the perspective of therole it performs, consists primarily in ensuring the security of its citizens. Solutionsundertaken to enable the organisation and continuous operation of a given countryinclude all conceivable states and conditions relevant for its functioning, solutions andpossibilities of taking up actions in situations of hazards and crises.The article defines legal conditions for the functioning of the state in situationsof specific hazards and crisis situations, including determinants of administrativestates that underlie national management. The authors simultaneously analyse legalprerequisites for improving the state of defence readiness and introducing alert levels,as well as elements of the country’s functioning in situations threatening human lifeand health
