Summary/Abstract: The work under the mentioned title is best understood as a kind of contribution to a more complete and objective understanding of state legal problems that arose at the time of actualization of the issue of the state organization of the future Yugoslav community. The focus of the author's work is on the legal-theoretical analysis of the basic conceptions of state organization projected by the dominant holders of Serbian and Croatian politics, on the eve of the creation of the "first" Yugoslavia. At the same time, the author starts from the thesis that the different views of the form of state organization - Serbian (unitary) and Croatian (confederalist) - cannot be properly understood without a certain, even if brief, reference to the historical-political background of the same. The complex and contradictory historical processes that the South Slavic peoples went through generalized the various ideological heritages of Serbian and Croatian political thought. Precisely for this reason, when trying to fit the divided national ideologies into the broader state legal framework of the Yugoslav community, conceptually different solutions for the state organization of the future Yugoslavia were designed and manifested.
