Summary/Abstract: In the laws on criminal procedure, which are applied in Bosnia and Herzegovina, it is stipulated that the court evaluates the evidence presented at the main trial according to the principle of free evaluation of the evidence. However, certain deviations from this principle arise from the legal provisions. Therefore, a legal dilemma arises as to whether one can speak of absolute or conditional judicial freedom to evaluate evidence. This problem will be the subject of consideration in the paper.
