Summary/Abstract: The current Romanian civil code regulates in art. 2 .324 the legal institution called "common guarantee of creditors". The content of the respective legal text is a resumption in another form of the provision of art. 1.718 and 1.719 of the previous Civil Code. Since the old legislation did not name the institution, the specialized literature identified by using the expressions of “general pledge of creditors”. These close expressions as forms have often created confusion with the notion "right of pledge "or" pledge", which are different in terms of content and prerogatives. The Common guarantee of creditors is a legal institution that is characterized by a set of features that give it a distinct legal regime
